Fampitana sy fampahafantarana any ivelany ny antontan-taratasy ara-pitsarana sy tsy ara-pitsarana amin’ny raharaha sivily na ara-barotra;

Fanekena sy fanatanterahana ny didim-pitsarana vahiny amin’ny raharaha sivily na ara-barotra.

Nandritra ny fanokafana no nanamafisan-dRamatoa Fanirisoa ERNAIVO, Mpitahiry ny Fitombokasem-panjakana, Minisitry ny Fitsarana, ny maha-zava-dehibe ireo fifanarahana iraisam-pirenena hodinihina, izay heverina fa hitondra anjara biriky lehibe amin’ny fanamafisana ny fiaraha-miasa ara-pitsarana sy ny fanatsarana ny tontolo ara-dalàna eto Madagasikara.

Un atelier d’information et de consultation consacré aux projets de loi visant à autoriser l’adhésion de Madagascar à quatre (04) Conventions internationales adoptées dans le cadre de la Conférence de La Haye de droit international privé (HCCH) s’est tenu ce 08 juin 2026 à la Bibliothèque du Ministère de la Justice à Faravohitra.

Ces Conventions portent notamment sur :

La reconnaissance et l’exécution des décisions en matière de divorce et de séparation de corps ;

La suppression de l’exigence de légalisation des actes publics étrangers (Convention Apostille) ;

La transmission et la notification à l’étranger des actes judiciaires et extrajudiciaires en matière civile ou commerciale ;

La reconnaissance et l’exécution des jugements étrangers en matière civile ou commerciale.

Dans son allocution d’ouverture, Madame Fanirisoa ERNAIVO, Garde des Sceaux, Ministre de la Justice, a souligné l’importance de ces Conventions internationales, qui constituent un levier majeur pour le renforcement de la coopération judiciaire ainsi que pour la modernisation et l’amélioration du cadre juridique malgache.

L’atelier a également été honoré par la présence de Madame Hanitra RAZAFIMANANTSOA, Ministre en charge de la Refondation, et de Monsieur RALAMBOZAFIMBOLOLONA RAZAFITSIMIALONA ANDRIATSIVOAFETRA, Vice-Président de l’Assemblée nationale. Tous deux ont réaffirmé l’importance de ces projets de loi dans le processus de modernisation du système juridique national et dans le renforcement de la coopération judiciaire entre Madagascar et la communauté internationale.

Des responsables et experts techniques issus des institutions concernées ont également pris part aux travaux. Les échanges ont permis d’examiner les différentes dispositions des projets de loi et de recueillir des recommandations destinées à les enrichir avant la poursuite de la procédure d’adhésion de Madagascar à ces Conventions internationales.

An information and consultation workshop on draft legislation aimed at authorizing Madagascar’s accession to four (04) International Conventions adopted under the framework of the Hague Conference on Private International Law (HCCH) was held on 08 June 2026 at the Library of the Ministry of Justice in Faravohitra.

These Conventions relate in particular to:

The recognition and enforcement of judgments relating to divorce and legal separation;

The abolition of the requirement for legalization of foreign public documents (Apostille Convention);

The service and transmission abroad of judicial and extrajudicial documents in civil and commercial matters;

The recognition and enforcement of foreign judgments in civil and commercial matters.

In her opening remarks, Ms. Fanirisoa ERNAIVO, Keeper of the Seals and Minister of Justice, emphasized the importance of these international conventions, which constitute a key lever for strengthening judicial cooperation as well as for modernizing and improving Madagascar’s legal framework.

The workshop was also attended by Ms. Hanitra RAZAFIMANANTSOA, Minister of Refoundation, and Mr. RALAMBOZAFIMBOLOLONA RAZAFITSIMIALONA ANDRIATSIVOAFETRA, Vice-President of the National Assembly. Both underscored the importance of these draft laws in the ongoing process of modernizing the national legal system and reinforcing judicial cooperation between Madagascar and the international community.

Senior officials and technical experts from the relevant institutions also took part in the proceedings. The discussions made it possible to examine the various provisions of the draft bills and to collect recommendations aimed at improving them ahead of Madagascar’s further steps toward accession to these international conventions.
